BMG acquires Sanctuary catalogue
The Sanctuary catalogue, acquired by Universal when it bought the Sanctuary Music Group in 2007, was one of the latter assets put up for sale.

This is the formal position of DGM / Panegyric...
 
Sanctuary’s catalogue has been acquired by BMG. We have a number of unresolved issues with Sanctuary/UMG. The outline issues include...
 
1.     Unauthorised digital sales of the albums "The Power to Believe" and  "Happy With What You Have..." - Sanctuary, Sanctuary/UMG never had digital rights in these titles.
 
2.     Further unauthorised sales of these titles after Sanctuary/UMG was alerted to these sales & assurances were given that such sales would cease. They never did cease completely.
 
3.     Unauthorised post-term & reduced price sales of "The Power to Believe" and "Happy With What You Have..."
 
4.     Further unauthorised sales of these titles after assurances were given that such sales would cease. They never did cease.
 
5.     Allowing former Sanctuary consignment distributors to make unmonitored disposal/sale/destruction of stock of the albums
"The Power to Believe" and "Happy With What You Have..." without rights, payment or retention of records of quantities involved as is an MCPS requirement under the terms of the license to manufacture.
 
6.     Failure to retain or produce records of manufacture of the albums "The Power to Believe" and "Happy With What You Have..." as is an MCPS requirement under the terms of license to manufacture.
 
7.     Publishing underpayments/under-reporting related to the above.
 
8.     The taking and editing a track from the King Crimson album "In the Court of The Crimson King", at the direction of a Sanctuary staff member, from a commercial CD without a license being sought or granted, the placement of the newly edited track, with false metadata, as Track 1 CD1 on a boxed set by another artist (Emerson, Lake & Palmer), which was then issued and sold in a number of territories by Sanctuary/UMG. (It was issued shortly after the UMG acquisition). Failure to retain records of manufacture of this title. Late and incorrect filing of information relating to the boxed set with MCPS leading to publishing underpayment.
 
Our legal costs to date with regards to the above - all of which are acknowledged as having happened by Sanctuary/UMG - costs which are, as a result, also due to be reimbursed to us by Sanctuary/UMG.
